Terms of Service

1. Acceptance of Terms

By accessing or using AccuCV (the "Service"), operated by AccuCV ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. You must be at least 18 years of age to use the Service.

2. Description of Service

AccuCV is an AI-powered resume tailoring tool. You provide a job description and your professional profile, and the Service uses large language model technology to generate a tailored, ATS-optimized resume. The Service is provided on a subscription or free-tier basis as described at the time of sign-up.

Generated resume content is produced by artificial intelligence and is intended as a starting point. You are solely responsible for reviewing, verifying, and editing all AI-generated output before submitting it to any third party. See our AI Use Disclosure for full details.

3. Account Registration

You must create an account to use the Service. Account authentication is handled by Clerk, Inc. You agree to:

Provide accurate and complete registration information;
Keep your login credentials confidential;
Notify us immediately of any unauthorized access at privacy@accucv.ca;
Take responsibility for all activity occurring under your account.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently or in violation of these Terms.

4. Subscription, Billing, and Cancellation

Free tier. New accounts receive a limited number of free resume generations. Once exhausted, you must upgrade to continue.

Paid subscriptions. Paid plans are offered on a monthly or annual basis. Subscription fees are charged in advance through Stripe, Inc. All fees are in USD and are non-refundable except as required by applicable law or at our sole discretion.

Cancellation. You may cancel your subscription at any time through your account settings or by contacting us. Your access to paid features continues until the end of the current billing period. We do not provide prorated refunds for partial months.

Price changes. We may change subscription pricing with at least 30 days' notice sent to your registered email address.

5. Acceptable Use

You agree not to use the Service to:

Generate fraudulent, misleading, or defamatory content;
Circumvent usage limits through automation, scraping, or multiple accounts;
Resell, sublicense, or commercially redistribute the Service without our written consent;
Upload malicious code or interfere with the Service's infrastructure;
Violate any applicable local, national, or international law or regulation.

6. Your Content and Intellectual Property

Your content. You retain full ownership of the professional information, work history, and job descriptions you provide ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to process Your Content solely for the purpose of delivering the Service to you. We do not use Your Content to train AI models.

Generated output. Subject to your compliance with these Terms, you own the AI-generated resume content produced using Your Content. We make no claim to that output.

Our property. The AccuCV name, logo, product design, and underlying software are the exclusive property of AccuCV and may not be reproduced without express written permission.

7. Third-Party Services

The Service integrates third-party platforms including Clerk (authentication), Stripe (payments), and Anthropic (AI processing). Your use of those platforms is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of any third party.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

AI-generated resumes are not a guarantee of employment. You are solely responsible for the content you submit to prospective employers.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACCUCV INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time via the Account & Data page. Upon termination, your right to use the Service ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles. Nothing in this section limits any consumer protection rights you may have under the mandatory laws of your country of residence.

We encourage you to contact us first at privacy@accucv.ca to resolve any dispute informally. If a dispute cannot be resolved informally, both parties agree to submit to the non-exclusive jurisdiction of the courts of competent jurisdiction in Canada.
